1. Scope and Contractual Partner
These Terms and Conditions (T&C) apply to all contracts for the digitization of media concluded between Basqueluma GmbH (share capital €35,000, Managing Director Andreas Mayer, Maria-Theresien-Straße 42, 6020 Innsbruck) and the customer. These terms are supplemented by the provisions of the Austrian Consumer Protection Act (KSchG) and the Distance and Off-Premises Trade Act (FAGG).
2. Order Placement and Booking
A contract is formed when the customer submits a request via the contact form or email and Basqueluma GmbH accepts this request. By handing over the physical media (cassettes, films, reels), the customer agrees to these T&C. The detailed service descriptions are available in the price list at /en/services.html.
3. Pricing and Payment Terms
All prices listed on the website include the statutory Value Added Tax (VAT) of 20%. To secure the order, a deposit of 30% of the estimated total value is required.
For business customers (B2B), a payment term of 14 days from the date of invoicing applies. Private customers settle the remaining balance upon the delivery of the digitized data or the return of the original media.
4. Processing Times and Rush Orders
The standard processing time is 12 business days from the receipt of the media. In exceptional cases, rush orders may be agreed upon; these are subject to a surcharge of 50% on the standard price. The stated periods are guidelines and not fixed delivery dates unless otherwise agreed in writing.
5. Ownership and Copyright
The customer warrants that they are the legal owner of the submitted media or possess the necessary rights for digitization. Basqueluma GmbH does not create copies of commercial productions or third-party copyrighted works without explicit authorization.
The digital copies become the property of the customer. Basqueluma GmbH deletes all internal working copies after 60 days following project completion, unless a longer archiving period has been requested in writing. For more details on data processing, please refer to our Privacy Policy.
6. Liability and Insurance
Basqueluma GmbH commits to the professional and careful handling of original media. Insurance for media during transport is only provided upon explicit agreement and assumption of costs by the customer. No liability is accepted for damage to original media resulting from aging, material defects, or chemical degradation (e.g., vinegar syndrome).
7. Right of Withdrawal and Cancellation
Consumers are entitled to the statutory right of withdrawal according to the FAGG. However, this right expires prematurely once the digitization has begun at the express request of the customer, as it constitutes an individualized service. Cancellations after the commencement of work will be offset against the costs already incurred.
8. Final Provisions and Jurisdiction
Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected. The laws of the Republic of Austria apply. The place of jurisdiction for all disputes arising from this contractual relationship is Innsbruck.
For complaints regarding data protection, the Austrian Data Protection Authority (DSB), Barichgasse 40-42, 1030 Vienna, can be contacted. Further information is available in our Privacy section.
